Terms and Conditions

1. Eligibility

1.1. You must be at least 18 years old to use the App.

1.2. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

1.3. The App is designed for couples in consensual relationships. You may only connect with one other user ("Partner") at a time.

2. Account Registration

2.1. To use the App, you must create an account using Sign in with Apple, Google Sign-In, or email and password.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

2.4. You may not create an account on behalf of someone else or use another person's account without permission.

3. App Features and Use

3.1. Pairing: The App allows you to connect with one Partner using an invite code or link. Both users must consent to the pairing.

3.2. Pings: Quick messages you can send to your Partner. Free users have daily limits; premium subscribers have unlimited access.

3.3. Daily Prompts: Relationship questions (including text and poll formats) that both Partners can answer. Answers are revealed only after both Partners have responded and are shared only between paired Partners.

3.4. Love Notes: Personal messages sent to your Partner, which may appear on home screen widgets.

3.5. Photos: Images you upload are shared only with your Partner within the App, along with any reactions or comments either of you adds.

3.6. Songs: You may share songs with your Partner via iTunes integration.

3.7. Date Ideas: The App surfaces date suggestions based on location and preferences, which you may save, plan, or complete. Some suggestions are AI-generated or sourced from third-party providers (see Section 3a).

3.8. Time Capsules: Scheduled messages and media to be delivered to both Partners at a future date.

3.9. Timeline: A shared feed displaying pings, prompts, love notes, photos, songs, and completed dates between you and your Partner.

3.10. Streaks, Levels, and Couple Score: The App tracks consecutive days of engagement and awards a couple score and level based on activity. These are gamification features and carry no real-world value.

3.11. You agree to use all features responsibly and in accordance with these Terms.

3a. AI-Generated Content

3a.1. Some date ideas and suggestions are generated in whole or in part by artificial intelligence (including Google Gemini) and by third-party data sources such as Google Places and Ticketmaster.

3a.2. AI-generated and third-party content is provided for informational and inspirational purposes only. Details such as hours of operation, availability, pricing, safety, and event schedules may be inaccurate, outdated, or incomplete. You are responsible for independently verifying any information (by contacting the venue or consulting the event provider) before relying on it.

3a.3. We do not endorse any venue, event, or third-party provider, and we disclaim all liability arising from your reliance on AI-generated or third-party content.

4. User Content

4.1. "User Content" includes all text, photos, messages, and other materials you submit through the App.

4.2. You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and transmit your User Content solely for the purpose of providing the App's services.

4.3. You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to submit the User Content;
• Your User Content does not violate the rights of any third party;
• Your User Content does not contain illegal, harmful, or objectionable material.

4.4. We do not actively monitor User Content but reserve the right to remove content that violates these Terms.

5. Prohibited Conduct

You agree NOT to:

5.1. Use the App for any unlawful purpose or in violation of any applicable laws.

5.2. Harass, abuse, threaten, or intimidate any user, including your Partner.

5.3. Share content that is illegal, obscene, defamatory, or infringes on intellectual property rights.

5.4. Attempt to gain unauthorized access to the App, other accounts, or our systems.

5.5. Use the App to distribute spam, malware, or other harmful content.

5.6. Reverse engineer, decompile, or attempt to extract the source code of the App.

5.7. Use automated systems or bots to access the App.

5.8. Impersonate any person or entity.

5.9. Use the App if you are under 18 years of age.

6. Subscriptions and Payments

6.1. The App offers premium subscription plans ("Premium") with enhanced features.

6.2. Subscriptions are billed through Apple App Store or Google Play Store. Payment terms are governed by the respective platform's policies.

6.3. Subscription Options:

• Monthly subscription
• Annual subscription

6.4. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

6.5. You can manage or cancel your subscription through your device's app store settings.

6.6. Refunds are handled according to Apple App Store or Google Play Store policies.

6.7. Premium status applies to the couple account; when one Partner subscribes, both Partners benefit from premium features.

7. Privacy

7.1. Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

8. Intellectual Property

8.1. The App and its original content (excluding User Content), features, and functionality are owned by Lovestruck and are protected by copyright, trademark, and other intellectual property laws.

8.2. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8.3. "Lovestruck" and associated logos are trademarks of Lovestruck. You may not use these marks without our prior written permission.

9. Termination

9.1. You may delete your account at any time directly within the App (Settings > Delete Account) or by contacting us at support@kunolu.com. Account deletion is permanent and will remove your personal data and associated User Content, subject to the retention terms in our Privacy Policy.

9.2. We may suspend or terminate your account at any time, with or without cause, with or without notice, including for violation of these Terms.

9.3. Upon termination, your right to use the App ceases immediately. We may delete your account and User Content.

9.4. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers

10.1. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.3. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE APP.

10.4. THE APP IS NOT INTENDED TO PROVIDE RELATIONSHIP COUNSELING OR THERAPY. FOR RELATIONSHIP ISSUES, PLEASE CONSULT A QUALIFIED PROFESSIONAL.

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVESTRUCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

11.3. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lovestruck and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Dispute Resolution

13.1. These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13.2. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation.

13.3. If informal resolution fails, you and Kunolu Applications Inc. agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada for the resolution of any disputes, except where prohibited by applicable consumer protection laws in your jurisdiction of residence.

13.4. To the extent permitted by applicable law, you agree to waive any right to participate in a class action lawsuit or class-wide proceeding.

14. Changes to Terms

14.1. We reserve the right to modify these Terms at any time.

14.2. We will notify you of material changes through the App or via email.

14.3. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. General Provisions

15.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lovestruck regarding the App.

15.2. Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.

15.3. Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

15.4. Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.

15.5. Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
